Romanian law still prohibits foreigners from owning land (although they can own the buildings on it). The Constitution guarantees that foreigners will be granted full ownership rights when the country joins the EU (expected to be in January 2007).
Most foreign buyers have sought to get round this rule by setting up Romanian companies. This can be a difficult, confusing and complicated process, with extensive forms to complete. In turn, very regular trading returns must be filed with the tax authorities. The transfer to your complete ownership after EU Accession can also be potentially complicated if you choose to purchase in such a way.
We have found an easier, less complicated and more secure methods to process property purchases by foreign buyers.
One possibility is to pass ownership of the building to the buyer, together with a right to occupy and enjoy the land. This can be backed up by an agreement to transfer full ownership of the land to the buyer when possible, enforceable in UK law.
A third possibility is a 999 year lease with the right to buy the freehold for a nominal sum.

The purchase will be completed, usually in half a day, at the office of a Notary who will have already completed a search and registered the transfer with the authorities. The new owner must then notify utility companies and pay any connection charges. We will accompany you and guide you through the process.
